Greenville City Council met Nov. 13.

Call to Order: The regular meeting of the Greenville City Council was called to order on Tuesday, November 13, 2018 at 7:04 p.m. by Mayor Alan Gaffner.
Roll Call: Present: Mayor Alan Gaffner, Councilman Bill Carpenter, Councilman John Gillard, Councilman Mike Heath and Councilman Kyle Littlefield.
Also Present: City Attorney Patrick Schaufelberger, City Manager Dave Willey and City Clerk Sue Ann Nelson.
The pledge of allegiance to the United States flag was recited.
Citizen Input: With no comments, citizen input was closed.
CONSENT AGENDA: Ordinance 3183 – Grant South Central Farm Service a Conditional Use Permit for Telecommunications Tower:
• Approval of minutes of the October 9, 2018 Regular Council Meeting, October 25, 2018 Special Council Meeting;
• Financial Statements for October 2018;
Conditional Use Permit for South Central Farm Service to construct a 120’ telecommunications tower in an Industrial Heavy zone at 1715 E City Route 40. Permit would include restrictions that all supplemental use regulations are followed, engineering plans and specifications be provide to the City of Greenville, and that the owner agrees to develop a plan and/or lease terms for the future placement of additional third- party communication or similar equipment on the tower, would need to be reviewed and accepted by the city, and that existing equipment on the City’s Beaumont tower be removed at the owner’s expense if it is no longer going to be used and does not serve any current customers
• Approval of Accounts Payable totaling $987,052.43;
• Approval of Committee Meeting Minutes of the October 5, 2018 Cemetery Board Meeting, October 22, 2018 Planning Commission Meeting, November 5, 2018 Band Board Meeting, November 5, 2018 Lake Committee Meeting;
• Approval of Administrative Reports of the Police Department, Public Works, Sewer and Water Departments, Building Permits, Code Enforcement, and Annual Greenville Public Library Report;
• Record Items – None.
2019 General Liability, Property and Workers Compensation Insurance:
Total premium for 2019 insurance proposal from IMLRMA quoted at $135,300.33. This matches the prior year’s premium as announced by IMLRMA in April.
Resolution 2018-9 2019 Motor Fuel Tax:

Annually the City must approve and submit to IDOT an Estimate of Maintenance Costs proposed for the upcoming calendar year. This must be submitted to IDOT by December 1st, and IDOT approval is required before any funds can be expended starting January 2019. For 2019 the MFT Maintenance Cost Estimate is $200,000, for MFT permissible uses.
Ordinance to establish 1974 pickup truck and police evidence GPS devices as surplus property to allow for their disposal (see ordinance on file for full text).
Resolution to amend horsepower limits on Governor Bond Lake and increase the outboard engine limit from 225 to 300 to accommodate industry standards for new boats. In addition, the placard in the boat must match the outboard engine, and only one motor is permitted. Inboard/outboard engines shall remain at 300 horsepower, and personal watercraft shall remain at 160 horsepower. Change is effective January 1, 2019.
Ordinance to require street address locations be posted on boat docks location on Governor Bond Lake to improve safety and welfare. New ordinance will require 4” street name to be affixed to each boat dock. Signs will be provided by the City of Greenville (see ordinance on file for full text).
Currently the city does not have a sign outlining cemetery rules posted at Montrose Cemetery. Ordinance will amend city code to enhance cemetery rules and regulations with the intent that new signage be installed. Cemetery board unanimously recommended approval (see ordinance on file for full text).
Payment to Barber Murphy for $4,500 for option commission fee on solar project.

Motion by Gillard seconded by Carpenter, to approve the consent agenda as presented.

Renters Utility Deposit Fee Discussion:
At last month’s council meeting, it was asked that the council consider raising the deposit fee for renters. Karl Breehne from 2 Creeks addressed the council and reiterated concerns he had shared with staff regarding large unpaid balances left by renters that become the responsibility of the landlord. He suggested that the increase in utility costs has outpaced the deposits required, and therefore asked that the deposit fee collected by the city be increased from $100 to $200. The payment process was also discussed, and it was noted that other communities enact a stricter past due policy. Mayor Gaffner indicated that the council would bring back the issue at the next council meeting.
Tax Levy Truth in Taxation Determination:
In preparation for the annual tax levy in December, discussion was held to determine if there is a desire to hold a truth in taxation hearing if there is the potential to exceed a 5% increase in the aggregate levy. It was the consensus not to exceed a 5% increase in the tax levy, and a truth in taxation hearing will not be required.
Elm Street Path Engineering Agreement:
At last month’s council meeting, the council reviewed the Preliminary Investigation report for a multi-use path with a cost estimate of $387,235 for an asphalt path and the consensus was to proceed to the next step to get engineering cost. Proposal from Juneau Associates is $44,048. Motion by Gaffner, seconded by Gillard, to approve proposal from Juneau Associates for preliminary engineering, surveys and easement documents, IDOT report submission and ITEP application for Elm Street pedestrian route for $44,048.

Solicitors Permit Discussion:
Police Chief Runyon had suggested that the current solicitors permit code be reviewed. After staff review of other communities and ordinances, the following changes were proposed to Greenville city code; increase the application and permit fees, require badges to be worn by solicitors, limit hours of solicitation, and solidify the policy for non-profits and charitable organizations. An ordinance will be presented at a future meeting for council consideration.
Drug Update: City Manager reported that police department is fully staffed and that once all field training has been completed an officer will be assigned to the drug task force.
Appointment to Boards and Commissions:
Mayor Gaffner offered the name of Will Fairbanks for the Band Board. Motion by Gillard, seconded by Littlefield, to appoint Will Fairbanks to the Band Board for a term through 2022.

Old Business: Councilman Littlefield inquired as to the process of providing the Home Walk-Thru Checklist after someone has rented a property. It was discussed that when a resident opens an utility account is the first opportunity that the City has make a renter aware of their rights and what the city can do to assist.
Mayor Gaffner indicated that he was interested in staff conducting some smaller meetings with various groups to further discuss the occupancy permit issue.

Labor’s Local 773 Collective Bargaining
Motion by Gillard, seconded by Littlefield, to approve the Laborer’s Local 773 Union Contract for the Street, Water and Sewer departments
Agreement: retroactive from June 1, 2018 through May 31, 2021.
Ayes: Gillard, Littlefield, Carpenter, Heath, Gaffner Nays: None Motion carried.
Nonrepresented Staff Pay Adjustments:
City Clerk Motion by Littlefield, seconded by Carpenter, to approve nonrepresented staff pay adjustments for employees not covered under union contract retroactive back to May 1, 2018.
