Greenville City Council grants environmental site closure

Call to Order: The regular meeting of the Greenville City Council was called to order

on Tuesday, June 14, 2016 at 7:39 p.m. by Mayor Alan Gaffner.

Roll Call: Present: Mayor Alan Gaffner, Councilman Jes Adam,

Councilman John Gillard, Councilman Mike Heath and

Councilman Roger Sanders.

Also Present: City Attorney Patrick Schaufelberger, City Manager

Dave Willey and City Clerk Sue Ann Nelson.

The pledge of allegiance to the United States flag was recited.

Citizen Input: With no comments, citizen input was closed.

Owner of the property where underground storage tanks previously

were maintained at 301 Franklin Avenue is seeking an environmental

site closure. During the removal of the tanks from the site in May

2011, a petroleum release was reported to IEMA. All chemicals of

concern have been actively remediated or have been addressed at the

site. To satisfy EPA requirements, request has been made to the city

to pass an ordinance to restrict the installation and use of potable

water wells within the affected area.

Request has been made from the Bond County Animal Control Officer

to amend city code that requires animals be held for at least ten days

for redemption to seven day redemption for all animals and three day

redemption for cats that are known strays and appear to be feral.

Approval of Consent

Agenda:

sewer plant is no longer working. Cost proposal from Municipal

Equipment, the only regional distributor, is $9,856 for parts to rebuild

the influent pump ‘wet end’. Sewer department personnel will

perform the labor.

Motion by Adam, seconded by Gillard, to remove the Groundwater

Use Ordinance and approve the remaining consent agenda as

presented.

Councilman Adam requested a further explanation regarding the

groundwater ordinance to which City Manager explained that due to

previous underground tanks which have been cleaned up, this

ordinance would prohibit installation and use of potable water wells

within the affected areas. Motion by Adam, seconded by Sanders, to

approve Ordinance 3092 regarding Groundwater Use at 301 Franklin

Avenue (See ordinance on file for full text).

Appropriations

Ordinance Public

Hearing :

Mayor Gaffner opened the Appropriations Public Hearing at 7:43 p.m.

City Manager Willey presented the Appropriations Ordinance. There

were no comments or opposition noted by the public. Mayor Gaffner

closed the public hearing at 7:45 p.m.

Ordinance 3094 - 2016-

2017 Appropriations

Ordinance :

Motion made by Gillard, seconded by Heath, to approve Appropriations

Ordinance totaling $32,235,112 for fiscal year May 1, 2016 through

April 30, 2017 (see ordinance on file for full text).

Water Distribution

Radio Read Proposal:

Proposal was presented for radio read transmitters to install on water

meters to allow electronic capturing of meter readings, reading

equipment and software and programming totaling $474,453.83, with

the initial setup cost to be $407,510. Motion by Gillard, seconded by

Sanders to approve proposal from HD Supply Waterworks for radio read

equipment.

Discussion to Amend

Use Matrix Table and

Addition of Liquor

Classifications and

Hours:

City Manager Willey explained that with the Unserved Sewer Project,

Willie’s Place bar and the VFW just outside the city limits had expressed

interest in annexing into the City in order to get city sewer connection.

Before they would be interested in annexing, the City would need to add

bar or tavern liquor license classification. This facilitated the request to

the Plan Commission to amend the Use Matrix Table. Plan

Commission held a public hearing regarding a request from the City of

Greenville to change permitted and conditional use in the Use Matrix

Table in the category of bars, taverns, and nightclubs. Plan

Commission unanimously recommended to change the Use Matrix

Table where a bar or tavern would be a conditional use in the

Commercial Neighborhood (CN), Commercial General (CG) and

Commercial Large-Scale (CL) zones and remove the permitted use in

the Downtown zone.

With the Plan Commission recommendation to amend the Use Matrix

Table for bars, taverns and nightclubs in Commercial Neighborhood

(CN), Commercial General (CG) and Commercial Large-Scale (CL)

zones, the next step would be for the council to establish a bar or tavern

liquor license. Currently there does not exist a bar or tavern license

within the city limits.

Following a recent request for a special event liquor license to cater an

event, the council indicated interest in considering the addition of a

caterer license. Staff is proposing a caterer liquor license for incidental

alcohol with food service on a contract basis, consistent with the state

caterer classification.

Retailers have requested that the Sunday alcohol selling times be

amended to accommodate consumers wanting to purchase alcohol on

Sundays earlier than the current noon sales time. Staff has proposed

amending Sunday sales to the same start time as the other days of the

week.

only to allow time for any public input, but would be brought back at the

July council meeting.

2016 Street

Improvements:

Bids were received from four contractors for 2016 street improvement

program which includes a complete rebuild of South Street from Prairie

to Elm and mill and fill on the remaining streets.

Low bid was received from Rooters for $250,810. Motion by Adam,

seconded by Gaffner, to approve bid from Rooters for street

improvements as identified.

Ordinance 3095 –

Prevailing Wage:

Annual ordinance required per state statute adopting the State of

Illinois Department of Labor prevailing wages for all public works

projects, except those completed by city personnel. Motion by

Gillard, seconded by Adam, to approve the 2016 Prevailing Wage

Ordinance (see ordinance on file for full text).

Consumer Price Index

Water and Sewer Rate

Adjustment:

City Manager Willey presented the utility rate adjustments to be

effective June 1, 2016. Rates are automatically adjusted annually by

80% of the Consumer Price Index change. Consumer price index

increased slightly causing a rate increase of.68% effective June 1,

2016.

City Clerk

Land Purchase Option: City Manager detailed a request from Bob Johnson for a land purchase

option good through January 10, 2017 to purchase land owned by the

City of Greenville that would allow Mr. Johnson to build a road to land

owned by Mr. Johnson which is landlocked. The purchase price would

be $14,000 which is 100% of the appraised value. Motion by Gillard,

seconded by Adam, to approve Land Purchase Option with Mr. Bob

Johnson for $14,000.

Sanitary Sewer

Easement Payment:

The sanitary sewer line for the unserved sewer project runs along Route

40, Fourth Street and Hillview Drive, along the property owned by Don

Marti. The City needs Mr. Marti to grant an easement to install the

sanitary sewer line. Based on the square footage of the easement and

the unserved sewer formula developed by the City, the payment for the

easement totals $16,611.11. Mr. Marti has agreed in principal to the

easement contingent upon council approval of the easement payment.

This easement is necessary to begin the Fourth and Route 40 extension

of the unserved sewer project. Motion by Sanders, seconded by Heath,

to approve payment of $16,611.11 to Don Marti for sanitary sewer

easement.
