Greenville Planning Commission reviews development request

The city of Greenville Planning Commission met Sept. 29 to review development request.

Here are the meeting's minutes, as provided by the commission:

Makes recommendations to City Council on zoning and annexation issues; reviews and approves all new subdivisions and is involved in comprehensive planning to improve the health and welfare of the public.

Special Planning Commission Meeting Minutes Thursday, September 29, 2016 6:00 p.m.

Call to Order

The meeting of the Plan Commission was called to order by City Manager, Dave Willey. With the absence of Chairman Jack Chism, Brad Turner made a motion to have City Manager Willey chair the meeting, and Scott Spencer seconded. All voted in favor of having Willey act as chairman for the meeting.

Review of Previous Minutes

The minutes of the August 11, 2016 Plan Commission meeting were reviewed. Moved by Turner, seconded by Chance Vohlken, to approve the minutes.

PUBLIC HEARING # 1

Request from Dover Development LLC to add "Assisted Living Services", as a Conditional Use in the Commercial General (CG) zoning district to Table 153.0202(A) of the Unified Development Code (UDC), and to apply for a Conditional Use Permit to operate an assisted living facility/memory care center, on a portion of parcel number 05- 10-14-236-001.

Willey opened the public hearing at 6:05 p.m. Jordan Dorsey of Dover was sworn in and gave a brief synopsis of the development project. Jeff Benson of the Greenville Fire Protection District wanted to ask about drainage and fire protection, but the building plans have not been submitted yet, and it will all have to fall under city code, so no public discussion is needed on this. Public Hearing was closed at 6:10 p.m. A motion by Vohlken to add the Assisted Living Services as a Conditional Use Permit to the Commercial General (CG) Zone was made, and Cox seconded. All voted in favor of adding the Conditional Use Permit to the CG Zone.

A motion was then made by Vohlken, 2nd by Turner to grant a Conditional Use Permit to Dover Development, LLC. All voted in favor of the motion.

• Request from Greer Management to add "Congregate Living Services" as a Conditional Use in the Commercial Neighborhood zoning district to Table 153.0202(A) of the UDC, and to apply for a Conditional Use Permit to

operate a congregate living facility/memory care center, on a portion of parcel number 05-10-15-415-001 (WITHDRAWN BY APPLICANT 09-07-2016)

Willey advised that the request from Greer Management has been withdrawn along with their request to add "Congregate Living Services" as a Conditional Use.

PUBLIC HEARING #3 Request from the City of Greenville to address multiple changes to Permitted and Conditional Uses in the Use Matrix, Table 153.0202(A), of the UDC.

Willey opened the Public Hearing at 6:13 p.m. This hearing is about the Use Matrix Table changes. No one was sworn in. Butch and Judy Willeford voiced questions and concerns over proposed changes in the sections pertaining to warehouses and trucking firms, commenting that they have some trucking firms interested in their property. Karl Breehne of 2 Creeks Trailer Park also was concerned that the trailer park zoning has been changed. Both Willeford and Breehne were upset because they did not receive individual letters notifying them of meetings and proposed changes; Willey advised proper procedure was followed in that meeting notices were published, placed on the radio, and posted. Willeford and Breehne asked the matter be tabled until they could review the proposed changes and discuss with city staff.

Vohlken made a motion to table the matter until the next meeting, and Turner 2nd. All voted in favor of tabling the matter until the next meeting. This public hearing was closed at 6:20 p.m.

PUBLIC HEARING #4

• Request from the City of Greenville to add an additional section in the Supplemental Use Regulations of the UDC for agriculture, and to eliminate agriculture as a permitted use in the Downtown (D) zone. City Manager Willey read and explained Section 153.1379 Agriculture page for the commissioners and asked for their comments and questions. Vohlken expressed concern regarding the wording could encompass private gardens. Code Enforcement Officer Joe Craver stated gardens are defined elsewhere in the code and this would not apply to them. Vohlken asked if there were any specific areas in downtown area that this section would apply to. Willey explained that an existing plot can continue to be grown as long as it is not left dormant over a year. It would be considered a Non- Conforming Use. However, a new grower would not be allowed to establish a new plot once this section is added. Judy Cox expressed further concern that the wording could be construed to include private gardens and said she would feel more comfortable if this issue was clarified. Joe Craver said he had been contacted by one individual who was adamantly against this section. Don Rogier could not be in attendance for the meeting tonight as he is out of town, but submitted a letter to Joe and asked that it be read to the commission. (see attached letter for complete questions) Mr. Rogier's questions, in part:

1. Where did the 3 acre being farmed in downtown come from? Willey explained these rules apply to all zoning

districts, not just downtown. 2. Will these regulations creep to other districts? Willey stated they already to apply to all districts. 3. Will they apply to anything being currently farmed? Willey commented the Non-Conforming Rule will apply. 4. Why is fescue not included as hay crop? Craver explained that it is native grass and grows wild everywhere and

is unruly. Willey went further to say that it is purposely not allowed due to aesthetic issue. 5. Why set at 3 acres? It appears the rule change is designed to apply to Executive Estates in the future. Willey explained that it will not apply to his lots on Ballyvaughn as long as Rogier continues to farm them as a Non- Conforming Rule. 6. Are all farming practices grandfathered? Willey referred to the Non-Conforming Rule.

7. What about a wet spring and the land couldn’t not be cultivated before the weeds are taller than 10 inches?

Willey stated that the City would treat each situation according to allowable conditions. 8. What about chemical use in the City? Craver advised that the city has no code on this, so it would follow state

and federal regulations.

After further discussion, Turner made a motion to approve the addition of the section with the addition of "Exceptions - Gardens, and new language to clarify Agriculture. Spencer seconded and all voted in favor of the motion.

A motion by Turner, seconded by Vohlken, to remove Agricultural Uses in Downtown district in the Use Matrix Table 153.0202(A) of the UDC. All voted in favor.

A motion was made by Turner, seconded by Vohlken, to adjourn. All voted in favor of adjourn at 7:25 p.m.
