City of Jacksonville Plan Commission met June 6.

Here is the minutes provided by the Commission:

Chair Michael Oldenettel called the monthly meeting of the Jacksonville Plan Commission to order at 6:00 p.m. in the City Council Chambers. The agenda and petition were published with the local media and by posting at the Municipal Building.

Roll Call: Answering present: Michael Oldenettel – Chairman, Brad Besson – Vice-Chairman, John Heyer – Secretary, Casey Collins, Kerris Osborn; City Attorney Dan Beard; City Clerk Skip Bradshaw. Absent from the meeting were members Bill Scott and Brad Cors; Community Development Director Kelly Hall. A quorum was declared.

Minutes: Motion was made by Collins, seconded by Heyer, to approve the March 7, 2018 Minutes as presented in advance. By voice vote, motion carried.

CC Bradshaw read Item #3 on the agenda. Review petition to rezone property at 910 South Clay from R-3 to R-5, with the intent of property owners, Daniel & Ashley Casey, to make the current structure into three apartment units. CC Bradshaw swore in Daniel Casey to represent this petition. Mr. Casey explained that his intent is to turn the structure into a three-unit apartment house by adding another unit in the attic, which is full size. He does not plan to extend the structure beyond adding an exterior staircase for the third unit. The structure is currently a two unit apartment house with an external entrance to the second unit on the second floor.

Chair Oldenettel asked for discussion, or if there was anyone in attendance to speak in favor of, or opposition to, this request. A letter of objection was previously submitted by Margie Bryant. CC Bradshaw swore in Ms. Bryant to discuss her concerns. Ms. Bryant explained that even though the home is zoned single-family, at some point the home was converted into a two-family dwelling without going through the proper channels for rezoning. The Bryant’s property is adjacent to this property and they have had ongoing issues with the neighbors using and parking in their driveway, loud noise, and property damage since it changed into a two-family dwelling. The Bryant’s are very much opposed to the rezoning, and provided a signed petition from other neighbors who are also opposed to the rezoning. The Bryant’s have lived in their home for approximately 23 years.

Mr. Casey explained that he was aware that the property was zoned single-family when he purchased it in October. They have had major issues with the sewer system which may be the reason neighbors were using the Bryant’s driveway, to which Mr. Casey apologized to the Bryant’s for that. He has addressed the parking issue with the current occupants. Discussion ensued about the neighborhood. Robert Northrop also addressed the Commission with the same objections as the Bryant’s.

With no further discussion motion was made by Heyer, seconded by Besson, to deny this request based on Article 4, Section 4.9-1 Intent & Purpose, which is to protect and conserve areas of predominantly multi-family apartments, and this home is predominantly zoned single-family.

Roll Call: 4 Yeas; 0 Nays; 1 Abstain (Collins); 2 Absent (Scott, Cors)

Motion to deny carried 4-0-1-2.

CA Beard explained that this request will be presented to the Council for a vote and requires a 2/3 vote to pass at the Council level because one of the objectors owns at least 20% of the adjacent property.

CC Bradshaw read Item #4 on the agenda. Review petition to rezone property at 851 Grove Street from R-5 to R-1, with the intent of property owners, William W. Weller and Malinda L. Carlson, to use as a single family residence. CC Bradshaw swore in William Weller to represent this petition. Mr. Weller explained that he and Ms. Carlson recently purchased the property and their intent is to convert it into a single-family dwelling to help improve the neighborhood. Exact plans have not been decided at this point. Mr. Weller is unsure as to the current use of the property, as the previous homeowner is in a nursing home at this time, but he believes the house has been somewhat divided because of separate utility bills. He is planning to do some landscaping and exterior improvements as well.

CA Beard explained that this request technically qualifies as a “spot zoning” request, but normally the objections to “spot zoning” involve multi-family housing coming in to a single-family area, or if you have a business that wants to rezone a residential property into a business property. In CA Beard’s opinion, there are no concerns with spot zoning at this location.

Chair Oldenettel asked for further discussion, or if there was anyone in attendance to speak in favor of, or opposition to, this request and there were none. Motion was made by Heyer, seconded by Collins, to approve this request.

Roll Call: 5 Yeas; 0 Nays; 2 Absent (Scott, Cors)

Motion carried 5-0-2.

Other Business: No discussion.

Public Comment: No discussion.

Adjournment: With no further discussion motion was made by Heyer, seconded by Osborn, to adjourn the meeting at 6:19 p.m.
