Illinois' Frese on gun ban lawsuit: 'The TRO preventing the new gun ban from going into effect has been upheld'

In a Feb. 1 Facebook post, Illinois state Rep. Randy Frese (R-Quincy) shared an update about the temporary restraining order against the state's newest gun control law.

"The TRO preventing the new gun ban from going into effect has been upheld," the legislator said in the post.

The temporary restraining order (TRO) that Frese referred to was part of a lawsuit filed by Illinois attorney Thomas DeVore on behalf of 866 plaintiffs. The TRO was issued by Effingham County Judge Joshua Morrison.

"Due to the speed with which this bill was passed, the effect to protected classes could not have been considered, nor could the Legislature have studied if this was the least restrictive way to meet their goal," the judge wrote in his ruling, quoted in a WTTW report.

On Jan. 21, FOX 32 Chicago announced that an appellate court had upheld the restraining order granted by Morrison.

The Fifth District appellate court voted 2-to-1 to uphold the TRO, an NBC 5 Chicago report said. The ruling found that the lawsuit filed in Effingham County can proceed and the TRO issued by Morrison can remain in effect, although in a narrower scope than previously found.
