City of Jacksonville City Council met Oct. 23.

Here are the minutes provided by the council:

Members of the public have the option to attend the in-person City Council meeting or watch the live City Council meeting via live video located on the City of Jacksonville’s website www.jacksonvilleil.gov

The Jacksonville City Council Meeting was called to order at 6:35 p.m. by Mayor Andy Ezard in the Council Chambers of the Municipal Building. The meeting was publicly announced by posting and by written notice to the local newspaper and radio stations.

ROLL CALL: The following answered present: Aldermen Don Cook, Kent Hannant, Brett Henry, Joe Lockman, Lori Large Oldenettel, Alison Rubin de Celis, Darcella Speed, Mary Watts, Eren Williams; Mayor Andy Ezard; City Attorney Dan Beard; City Clerk Skip Bradshaw. Absent from the meeting was Alderman Aaron Scott. A quorum was declared.

MINUTES: Motion was made by Cook, seconded by Speed, to accept the October 10, 2023 Minutes as presented in advance. By voice vote, motion carried.

PETITIONS: No discussion.

COMMUNICATIONS: No discussion.

CLAIMS: No discussion.

MAYOR’S REPORT:

1. Appointment of Laura Bandy to the Jacksonville Public Library Board, term expires October 1, 2024. Motion was made by Watts, seconded by Oldenettel, to accept the Mayor’s appointment. By voice vote, motion carried.

CITY ATTORNEY’S REPORT:

1. Resolution approving collective bargaining agreement with International Union of Operating Engineers, Local No. 399 (Water and Sewer Departments). Motion was made by Henry, seconded by Lockman, to accept the resolution. CA Beard read the resolution as proposed.

2023-R-155 Be it resolved by the City Council of the City of Jacksonville, Morgan County, Illinois, that a Resolution APPROVING AGREEMENT BETWEEN THE CITY OF JACKSONVILLE, ILLINOIS, AND INTERNATIONAL UNION OF OPERATING ENGINEERS, LOCAL 399 WATER AND SEWER DEPARTMENTS (Term: Retroactive to January 1, 2023 through December 31, 2026), is hereby approved.

Mayor Ezard asked for discussion and there was none.

ROLL CALL: 9 Yeas; 0 Nays; 1 Absent (Scott)

Motion carried 9-0-1.

2. First Reading of an Ordinance, with Emergency Clause, vacating an unnamed alley located between Independence Street and Dunlap Street. Motion was made by Watts, seconded by Williams, to accept the Emergency Clause.

ROLL CALL: 9 Yeas; 0 Nays; 1 Absent (Scott)

Motion to accept the Emergency Clause carried 9-0-1.

Motion was made by Hannant, seconded by Oldenettel, to accept the second reading of the ordinance. CA Beard read the ordinance as proposed.

2023-O-025 Be it ordained by the City Council of the City of Jacksonville, Morgan County, Illinois, that an Ordinance VACATING AN UNNAMED ALLEY BETWEEN WEST INDEPENDENCE AND WEST DUNLAP WITH EMERGENCY CLAUSE, is hereby approved.

Mayor Ezard asked for discussion and there was none.

ROLL CALL: 9 Yeas; 0 Nays; 1 Absent (Scott)

Motion to accept the second reading of the Ordinance carried 9-0-1.

CITY CLERK’S REPORT:

1. Resolution authorizing renewal of agreement with the Board of Commissioners of Morgan County regarding the Morgan County Animal Control Program. Motion was made by Rubin de Celis, seconded by Henry, to accept the resolution. CA Beard read the resolution as proposed.

2023-R-146 Be it resolved by the City Council of the City of Jacksonville, Morgan County, Illinois, that a resolution AUTHORIZING AMENDMENT AND RENEWAL OF AGREEMENT BETWEEN THE CITY OF JACKSONVILLE, ILLINOIS, AND BOARD OF COMMISSIONERS OF MORGAN COUTY, ILLINOIS RE:

MORGAN COUNTY ANIMAL CONTROL PROGRAM – (Term: January 1, 2024 through December 31, 2026 - $52,848 annually, paid quarterly – $13,212 on January 1, April 1, July 1 and October 1 of each year, plus appropriate fees), is hereby approved.

Mayor Ezard asked for discussion. CA Beard clarified that the cost of the agreement is based on population times $3, and it renews automatically on the anniversary date unless a letter of intent to discontinue services is received by either party. CC Bradshaw advised that the County increased their annual allotment from $15,000 in 2022 to $70,000 annually in 2023 moving forward.

PUBLIC COMMENT: Tyler Power, Head of Government Relations at Hy-Vee advised that there will be a ribbon cutting ceremony to celebrate the grand opening of the new store on Tuesday, October 24th at 10:00 a.m. He invited everyone to attend.

CONSENT AGENDA

CONSENT AGENDA: (Items addressed under the Consent Agenda are routine or are brought forward at the direction of the Council and are enacted with one motion. If discussions were desired, that item would be removed from the Consent Agenda and considered separately under the Committee Reports.)

1. City Treasurer’s Report – September 30, 2023. City Treasurer Beth Hopkins’ report for September 30, 2023, in which totals for cash receipts, cash disbursements, investments, and balances for all City bank and investment accounts were given.

PARKS & LAKES:

2023-R-156 Resolution AUTHORIZING WAIVER OF ADVERTISEMENT FOR BIDS; AND ACCEPTANCE OF PROPOSAL FROM MORROW BROTHERS FORD, INC. RE: 2023 Ford F350 Crew Cab – (Not to exceed $56,980)

PLANNING & PUBLIC WORKS: No discussion.

PUBLIC PROTECTION: No discussion.

SPECIAL STUDIES: No discussion.

2023-R-157 Resolution AUTHORIZING VARIOUS PAYMENTS FROM THE WATERWORKS & SEWERAGE PROJECTS FUND FOR CERTAIN

IMPROVEMENT PROJECTS - $33,606

(Geosyntec Consultants - $9,072; Hoerr Construction, Inc. - $4,584; Turner Painting & Construction - $19,950)

Motion was made by Watts, seconded by Speed, to accept the Consent Agenda. Mayor Ezard asked for discussion or if there were any items to be pulled from the Consent Agenda for further discussion and there were none.

Motion carried 9-0-1.

COMMITTEE REPORTS

FINANCE/IT/PERSONNEL: No discussion.

PLANNING & PUBLIC WORKS:

1. Second Reading of an Ordinance amending the Jacksonville Zoning map for property located at 1000 and 1002 Hardin Avenue from M-1 to R-3. Motion was made by Speed, seconded by Watts, to accept the second reading of the ordinance. CA Beard read the ordinance as proposed.

2023-O-024 Be it ordained by the City Council of the City of Jacksonville, Morgan County, Illinois, that an Ordinance AMENDING THE JACKSONVILLE ZONING MAP FOR PROPERTY LOCATED AT 1000 AND 1002 HARDIN AVENUE FROM M-1 (Light Industrial District) to R-3 (One Family Dwelling District), is hereby

approved.

Mayor Ezard asked for discussion and there was none.

OLD BUSINESS: No discussion.

NEW BUSINESS: Questions were raised from audience members as to whether or not there is a specific zoning classification for tiny homes. CDD Brian Nyberg is in the process of reviewing requirements for tiny homes and suggested that this matter be taken up with the Plan Commission. CA Beard suggested looking to an existing zoning classification of R-1 which would currently be the smallest footprint of a lot, and then impose any necessary restrictions. General discussion ensued regarding the pros and cons of allowing tiny homes in Jacksonville.

Ald. Oldenettel reminded the public that GFL trash cans are not to be left in the street. The trash can wheels are to be curbside on the boulevard or the end of the driveway with the handle facing toward the house. This is especially important during snow emergencies.

Ald. Oldenettel is concerned about the safety of the homeless in our community, especially with winter coming. She asked if there would be someone that could offer the most up to date information on what the City’s responsibility is in caring for the homeless and how they could be better served. Alan Bradish has been volunteering his time working with the homeless in Jacksonville for several years, he may be the person to provide this information. CDD Nyberg has also been working with Pastor Burries on this matter. General discussion ensued.

Ald. Oldenettel advised that Trick-or-Treating is allowed on October 30 and 31, from dusk to 9:00 p.m.

ADJOURNMENT: With no further discussion, motion was made by Cook, seconded by Speed, to adjourn the meeting at 7:10 p.m.
