City of Jacksonville Zoning Board of Appeals met July 3.

Here is the minutes provided by the Board:

Chair Oldenettel called the monthly meeting of the Jacksonville Zoning Board of Appeals to order at 10:50 a.m. in the City Council Chambers. The agenda and petition were published with the local media and by posting at the Municipal Building.

ROLL CALL: Answering present: Michael Oldenettel – Chairman, Brad Besson – Vice-Chairman, John Heyer – Secretary, Aaron Scott, Casey Collins; City Attorney Dan Beard; City Clerk Skip Bradshaw; Community Development Director Kelly Hall. Absent from the meeting were members Brad Cors and Kerris Osborn. A quorum was declared.

MINUTES: Motion was made by Heyer, seconded by Collins, to approve the June 6, 2018 Minutes as presented in advance. By voice vote, motion carried.

CC Bradshaw read Item #3 on the agenda. Review petition for variance for property located at 17 Windrush Dr. regarding the height of a fence. Property owned by Matt Rooney & Clint Stevens. CC Bradshaw swore in Mr. Stevens to represent this petition. Mr. Stevens explained that the property in question is on the corner of Windrush. The property line at the front of the house runs past a culvert used for overflow of the brook. The property owners are seeking permission to install a 6 foot privacy fence, as opposed to 3 feet, with two 4 foot gates across the culvert which will be 12 feet past the front of the house. Sight lines are not an issue. CDD Hall explained that this is really the owners only option and will not pose any problems to the neighbors as this is the last house on Windrush on the south side. Additionally, the lot to the east is not large enough to ever be buildable.

Chair Oldenettel asked for discussion, or if there was anyone in attendance to speak in favor of, or opposition to this request and there were none. Motion was made by Besson, seconded by Scott, to approve this request based upon the findings of fact in Section 11.3-4 of the Zoning Ordinance, numbers 2, 3, and 4, that the plight of the owner is due to unique circumstances; that the variation, if granted, will not alter the essential character of the locality; and that the granting the variation desired will not violate the general spirit and intent of this ordinance.

ROLL CALL: 5 Yeas; 0 Nays; 2 Absent (Cors, Osborn) Motion carried 5-0-2.

OTHER BUSINESS: No discussion.

PUBLIC COMMENT: No discussion.

ADJOURNMENT: With no further discussion motion was made by Heyer, seconded by Besson, to adjourn the meeting at 10:56 a.m.
