City of Rushville City Council met Aug. 7.

Here are the minutes provided by the council:

1. ROLL CALL & CALL TO ORDER

The Rushville City Council met in the meeting room of the City Hall Building. Upon convening, Mayor Jeff Ervin directed City Clerk, Stacey Briney to call the roll. Upon ROLL CALL, the following answered present: Council Members: Susan Acker, Richard Davis, Bob Fishel, Bryan Matteson, Barry Rebman, Mike Ryan, and Paul Trimble. The meeting was called to order at 7:00 P.M. Council Member, Terry Dodds was absent.

Others present included: Stacey Briney, City Clerk; Erin Wilson-Laegeler, City Attorney, Rick Wright, Chief of Police; David Haney of The Rushville Times; and Schuyler Isely, Economic Development Director.

2. OPENING PRAYER

The Opening Prayer was led by Mayor Jeff Ervin.

3. PLEDGE OF ALLEGIANCE

The Pledge of Allegiance was led by Mayor Ervin.

4. PUBLIC COMMENTS

There were no Public Comments at this time.

5. CONSENT AGENDA

All items on the Consent Agenda are considered to be routine in nature and will be enacted in one motion. There will be no separate discussion of these items unless a Council Member so requests, in which event, the item will be removed from the Consent Agenda and considered as the first item after approval of the Consent Agenda.

a) Approve the Minutes of the Regular Meeting held July 17, 2023

b) Approve the Minutes of the Grievance & Personnel Committee Meetings held July 12, 2023, & July 17, 2023; Cemetery Committee Meeting held August 2, 2023; & Finance Committee Meeting held August 2, 2023

c) Approve Claims for Council Approval Dated 08/07/23 & Accept Monthly Reports

d) Approve Hiring Johnnie Sutor as Waterer in Central Park

e) Approve Hiring Philip Kelle as Lifeguard (effective July 18, 2023)

f) Approve Appointment of Tyler Barr & JD Buss to the Scripps Park Board

g) Pass & Adopt Resolution No. 1146, Resolution to Include Taxable Allowances as IMRF Earnings

h) Pass & Adopt Resolution No. 1147, Resolution to Include Cash Payments Related to Health Insurance as IMRF Earnings

i) Approve Suspending the Rules RE: Ordinance No. 1364, Sale of Surplus Property

j) Pass & Adopt Ordinance No. 1364, Sale of Surplus Property

k) Approve Funding New Irrigation System for Golf Course

l) Approve Advertising for Bids for New Irrigation System at Golf Course

Rebman MOVED TO APPROVE THE CONSENT AGENDA. Fishel SECONDED, AND THE MOTION CARRIED WITH AN ALL “YEA” ROLL CALL VOTE AS FOLLOWS: 7 YEAS – Acker, Davis, Fishel, Matteson, Rebman, Ryan, & Trimble; 0 NAYS; 1 ABSENT – Dodds.

6. ITEMS TO BE REMOVED FROM CONSENT AGENDA – IF APPLICABLE All items were approved on the Consent Agenda.

7. DISCUSS & CONSIDER APPROVING BID FOR NEW ROAD AT SUNSET ADDITION IN CITY CEMETERY

Cemetery Committee Chairman, Bryan Matteson reported the committee had met and opened bids for the new road in the Sunset Addition. Matteson noted the followed bids were received:

• Pete Dupoy Construction - $19,300

• Laverdiere Construction - $32,850

• Hood Construction - $34,653.55

Matteson MOVED TO APPROVE ACCEPTING THE BID FROM LAVERDIERE CONSTRUCTION FOR THE NEW ROAD IN THE SUNSET ADDITION OF THE CITY CEMETERY IN THE AMOUNT OF THIRTY-TWO THOUSAND NINE HUNDRED FIFTY DOLLARS ($32,950). Rebman SECONDED, AND THE MOTION CARRIED WITH AN ALL “YEA” ROLL CALL VOTE AS FOLLOWS: 7 YEAS – Davis, Fishel, Matteson, Rebman, Ryan, Trimble, & Acker; 0 NAYS; 1 ABSENT – Dodds.

8. COUNCIL MEMBER & OFFICIAL’S REPORTS

Council Member, Bryan Matteson congratulated the District 17 girls senior league softball team on winning the world series. Matteson said this makes the community proud.

City Attorney, Erin Wilson-Laegeler reported she is finalizing the complaint on the Gordley property on East LaFayette Street. Attorney Wilson-Laegeler stated this property is more of a dangerous property than a nuisance. Attorney Wilson-Laegeler said her goal is to have the property demolished and have the property declared abandon. Attorney Wilson-Laegeler noted she is hoping to have this all done by this week.

Attorney Wilson-Laegeler also reported there is a seventeen-foot (17’) easement behind the third (3rd) tiny home on North Franklin Street that the 2x4’s for Hope is interested in for a turnaround, but no one is sure who it belongs to. City Clerk, Stacey Briney said that Superintendent of Operations, Eric Thurman had gone down there and said there is a manhole on that easement and possibly a sewer, but he was going to check it out. Council Member, Susan Acker asked if the court house could tell her who pays the taxes, and Attorney Wilson-Laegeler noted she checked there and apparently no one owns it. Attorney Wilson Laegeler stated if the city finds out who owns it, the 2x4’s for Hope would like to have it.

Attorney Wilson-Laegeler said she is also working on getting some overdue ordinance violations paid.

9. ADJOURN

Rebman MOVED TO ADJOURN. Fishel SECONDED, AND THE MOTION CARRIED WITH AN ALL “YEA” ROLL CALL VOTE AS FOLLOWS: 7 YEAS – Fishel, Matteson, Rebman, Ryan, Acker, & Davis; 0 NAYS; 1 ABSENT – Dodds. THE MEETING STOOD ADJOURNED ACCORDINGLY AT 7:08 P.M.
