McDonough County Board met June 13.

Here is the minutes provided by the board:

The McDonough County Board held a special meeting on Thursday, June 13, 2019 at 7:00 p.m. The meeting was held at the McDonough County Courthouse, in Courtroom 202. Board Members present included Chairman George Dixon, Vice Chairman Mike Cox, Travis Hiel, Larry Aurelio, Lee Calvert, Letha Clark, Dave Cortelyou, Joe Erlandson, Michael Kirby, Terra Litchfield, Bob Mahr, Julie Melvin, Rod McGrew, Dave Nissen, Scott Schwerer, Trevor Toland, Paul Trimmer, and Marcia Twaddle. Board Member Dick Marcott and Tessa Pfafman were absent. Others present included County Clerk

Gretchen DeJaynes.

Chairman Dixon called the meeting to order at 7:05 p.m.

Executive Session

Motion to enter into executive session for discussion of Pending Litigation under Illinois Open Meeting Act 5 ILCS 120/ 2 Sub-Section (C) (11) of the IL Open Meetings Act was made by Member Cox moved with a second by Member McGrew at 7:08 p.m. Motion carried with a roll call vote. A motion to exit executive session was made by Member Cortelyou moved with a second by Member Trimmer at 8:10 p.m. Motion carried with a roll call vote of 18 yeas, 0 nays, 2 absent and 1 vacant.

Member Hiel moved with a second by Member McGrew moved that the Board approve all of terms contained in the “Memorandum of Agreement” dated June 10, 2019 to settle all claims and judgments entered against the County pertaining to the Dayton v. Pledge lawsuit, McDonough County Case Number 20016-L-9, and further that we direct our attorneys to work with the Plaintiffs attorneys in drafting a settlement agreement in the accordance with the terms of said” Memorandum of Agreement,” Motion carried on a roll call vote with 18 yeas, 0 nays, 2 absent, and 1 vacant.

Member Hiel moved with a second by member Mahr that the Board demand that our insurance provider, Governmental Interinsurance Exchange, tender the policy limits to the Plaintiffs in the Dayton v. Pledge lawsuit, McDonough County Case Number 2006-L-9, as well as the judgment interest and costs as called for in County’s insurance policy, in accordance with the terms laid out in the “Memorandum of Agreement” dated June 10, 2019 and authorized States Attorney to provide said demand to GIE. Motioned carried on a roll call vote with 18 yeas, 0 nays, 2 absent, and 1 vacant.

Adjourn

With no further business to discuss, Member Toland moved with a second by Member Kirby to adjourn the meeting at 8:17 p.m.
