The Macomb City Council met in a regular session at 5:15 p.m. in the Council Chambers in City Hall, 232 E. Jackson Street, Macomb, IL

PLEDGE 

Mayor Inman called the meeting to order and led the Pledge of Allegiance.

ROLL CALL 

City Clerk Melanie Falk called the roll and the following Aldermen answered present: Mike Wayland, John Vigezzi, Don Wynn, Tom Koch, Gayle Carper, Tammie Leigh Brown-Edwards, Dennis Moon. All Aldermen being present, Mayor Inman declared a quorum for transaction of business. In addition to the Mayor, City Clerk and Aldermen, City Attorney Lisa Scalf, City Administrator Scott Coker were present. City Treasurer, Ronald Ward was absent.

Items on the Consent Agenda:

1. Minutes of the Macomb City Council meeting held Monday, March 1, 2021 and Committee of the Whole meeting on Monday, March 8, 2021.

CONSENT AGENDA ADOPTED

Alderman Moon moved, seconded by Alderman Wynn to adopt the consent agenda as published, on question being put, Aldermen Wayland, Vigezzi, Wynn, Koch, Carper, Brown-Edwards and Moon being all Aldermen voting “Aye” on roll call and no “Nay” votes, Mayor Inman declared the motion carried.

PUBLICCOMMENT

There was no public comment.

City Attorney Scalf presented the following ordinance for second reading:

An ordinance authorizing the sale of certain personal property (equipment and vehicles) owned by the City of Macomb

ORDINANCE APPROVED NO. 21-04

Alderman Vigezzi moved, seconded by Alderman Koch to approve the ordinance authorizing the sale of certain personal property (equipment and vehicles) owned by the City of Macomb, on question being put, Alderman Vigezzi, Wynn, Koch, Carper, Brown-Edwards, Moon and Wayland being all Aldermen voting “Aye” on roll call and no “Nay” votes, Mayor Inman declared the motion carried and the ordinance was approved and became Ordinance No.21-04.

AWARD BID DOWNTOWN REVITILIZATION PHASE 2 MCCARTHY IMPROV

Alderman Moon moved, seconded by Alderman Wynn to award the low bid to McCarthy Improvement Company in the amount of $2,422,211.13 for the Downtown Revitalization Phase 2 project, on question being put, Aldermen Wynn, Carper, Moon, Wayland and Vigezzi being all the Aldermen voting “Aye” on roll call, Alderman Koch being all Aldermen voting “Nay” on roll call and Alderman Brown-Edwards voting “Abstain” on roll call, Mayor Inman declared the motion carried.

INTERIM FINANCING FOR LINE OF CREDIT TRANSPORTATION PROGRAM

Alderman Koch moved, seconded by Alderman Carper to award the bid for Interim Financing Services  for an ongoing line of credit to enable the City and McDonough County Transportation to meet cash flow needs for the transportation program to First Bankers Trust at 2.49%, on question being put, Aldermen Koch, Carper, Brown-Edwards, Moon, Wayland, Vigezzi and Wynn being all Aldermen voting “Aye” on roll call and no “Nay” votes, Mayor Inman declared the motion carried.

TRANSPORTATION COMPLIANCE DOCUMENTS APPROVED

Alderman Vigezzi, seconded by Alderman Carper to approve the following McDonough County Public Transportation compliance documents: Passenger Handbook, Reasonable Modification Policy, Reasonable Modification Request Form, Complaint Procedure/Policy, Complaint Form, Equal Employment Opportunity (EEO) Plan, Article VI Notice to the Public and Statement of Policy, on question being put, Aldermen Carper, Brown-Edwards, Moon, Wayland, Vigezzi, Wynn and Koch being all Aldermen voting “Aye” on roll call and no “Nay” votes, Mayor Inman declared the motion carried.

City Attorney Scalf presented the following resolution:

RESOLUTION AUTHORIZING EXECUTION AND AMENDMENT OF FEDERAL 5311 GRANT AGREEMENT

WHEREAS, the provision of public transit service is essential to the transportation of persons in the non urbanized area; and

WHEREAS, 49 U.S.C. § 5311 (“Section 5311”), make funds available to the State of Illinois to help offset certain operating deficits and administrative expenses of a system providing public transit service in non-urbanized areas; and

WHEREAS, the State of Illinois, acting by and through the Illinois Department of Transportation, is authorized by 30 ILCS 740/3-1 et seq. to provide the Section 5311 grant; and

WHEREAS, grants for said funds will impose certain obligations upon the recipient, including the provision by it of the local share of funds necessary to cover costs not covered by funds provided under Section 5311.

NOW, THEREFORE, BE IT RESOVED BY THE GOVERNING BOARD OF THE CITY OF MACOMB:

Section 1. That an application be made to the Office of Intermodal Project Implementation, Department of Transportation, State of Illinois, for a financial assistance grant under Section 5311 for fiscal year 2021 for the purpose of off-setting a portion of the Public Transportation Program operating deficits of the City of Macomb.

Section 2. That while participating in said operating assistance program the City of Macomb will provide all required local matching funds.

Section 3. That the mayor is hereby authorized and directed to execute and file on behalf of the City of Macomb such application.

Section 4. That the Mayor is authorized to furnish such additional information as may be required by the Office of Intermodal Project Implementation and the Federal Transit Administration in connection with the aforesaid application for said grant.

Section 5. That Mayor is hereby authorized and directed to execute and file on behalf of the City of Macomb Section 5311 Grant Agreement (“Agreement”) with the Illinois Department of Transportation, and amend such Agreement, if necessary, in order to obtain grant assistance under the provisions of Section 5311 for fiscal year 2021.

Section 6. That the Mayor is hereby authorized to provide such information and to file such documents as may be required to perform the Agreement and to receive the grant for fiscal year 2021.

RESOLUTION ADOPTED NO. 2021-06

Alderman Carper moved, seconded by Alderman Vigezzi to adopt the resolution authorizing execution and amendment of Federal 5311 grant agreement for fiscal year 2021, on question being put, Aldermen Brown-Edwards, Moon, Wayland, Vigezzi, Wynn, Koch, Carper being all Aldermen voting “Aye” on roll call and no “Nay” votes, Mayor Inman declared the motion carried and the resolution was adopted and became Resolution No. 2021-06.

City Attorney Scalf presented the following resolution:

RESOLUTION AUTHORIZING EXECUTION AND AMENDMENT OF DOWNSTATE OPERATING ASSISTANCE GRANT AGREEMENT

WHEREAS, the provision of public transportation service is essential to the people of Illinois; and

WHEREAS, the Downstate Public Transportation Act (30 ILCA 740/2-1 et seq.) (“Act”) authorizes the State of Illinois, acting by and through the Illinois Department of Transportation, to provide grants and make funds available to assist in the development and operation of public transportation systems; and

WHEREAS, the grants for said funds will impose certain obligations upon the recipient, including provision by it of the local share of funds necessary to cover costs not covered by funds provided under the Downstate Public Transportation Act.

NOW, THEREFORE, BE IT RESOLVED BY THE GOVERNING BODY OF THE CITY OF MACOMB:

Section 1. That the City of Macomb enter into a Downstate Public Transportation Operating Assistance Agreement (“Agreement”) with the State of Illinois and amend such Agreement, if necessary, for fiscal year 2021 in order to obtain grant assistance under the provisions of the Act.

Section 2. That the Mayor of the City of Macomb is hereby authorized and directed to execute the Agreement or its amendment(s) on behalf of the City of Macomb for such assistance for fiscal year 2021.

Section 3. That the Mayor of the City of Macomb is hereby authorized to provide such information and file such documents as may be required to perform the Agreement and to request and receive the grant funding for fiscal year 2021.

Section 4. That while participating in said operating assistance program the City of Macomb shall provide all required local matching funds.

RESOLUTION ADOPTED NO. 2021-07

Alderman Moon moved, seconded by Alderman Vigezzi to adopt the resolution authorizing execution and amendment of Downstate Operating Assistance grant agreement for fiscal year 2021, on question being put, Aldermen Moon, Wayland, Vigezzi, Wynn, Koch, Carper and Brown-Edwards being all

Aldermen voting “Aye” on roll call and no “Nay” votes, Mayor Inman declared the motion carried and the resolution was adopted and became Resolution No. 2021-07.

City Attorney Scalf presented the following resolution:

WHEREAS, the State of Illinois, acting by and through the Illinois Department of Transportation, is authorized by 30 ILCS 740/3-1 et seq. to provide the Section 5311 grant; and

NOW, THEREFORE, BE IT RESOLVED BY THE GOVERNING BOARD OF THE CITY OF MACOMB:

Section 1. That an application be made to the Office of Intermodal Project Implementation, Department of Transportation, State of Illinois, for financial assistance grant under Section 5311 for the term effective January 20th, 2020 and expiring on June 30th, 2023 (“Term”) for the purpose of off-setting a portion of the Public Transportation Program operating deficits of the City of Macomb.

Section 2. That the Mayor is hereby authorized and directed to execute and file on behalf of the City of Macomb such application.

Section 3. That the Mayor is authorized to furnish such additional information as may be required by the Office of Intermodal Project Implementation and the Federal Transit Administration in connection with the aforesaid application for said grant.

Section 4. That the Mayor is hereby authorized and directed to execute and file on behalf of the City of Macomb Section 5311 Grant Agreement (“Agreement”) with the Illinois Department of Transportation, and amend such Agreement, if necessary, in order to obtain grant assistance under the provisions of Section 5311 for the Term.

Section 5. That the Mayor is hereby authorized to provide such information and to file such documents as may be required to perform the Agreement and to receive the grant for the Term.

Alderman Vigezzi moved, seconded by Alderman Wynn to adopt the resolution authorizing execution and amendment of Federal Cares Act Section 5311 grant agreement, on question being put, Aldermen Wayland, Vigezzi, Wynn, Koch, Carper, Brown-Edwards and Moon being all Aldermen voting “Aye” on roll call and no “Nay” votes, Mayor Inman declared the motion carried and the resolution was adopted and became Resolution No. 2021-08.

RESOLUTION ADOPTED NO. 2021-09

Alderman Wynn moved, seconded by Alderman Vigezzi to adopt the resolution authorizing execution and amendment of Section 5311 grant agreement for fiscal year 2022, on question being put, Aldermen Vigezzi, Wynn, Koch, Carper, Moon and Wayland being all Aldermen voting “Aye” on roll call and Alderman Brown-Edwards being all Aldermen voting “Nay” on roll call, Mayor Inman declared the motion carried and the resolution was adopted and became Resolution No. 2021-09.

City Attorney Scalf presented the following ordinance for first reading:

Alderman Vigezzi moved, seconded by Alderman Moon to waive second reading of the ordinance, all Aldermen voted “Aye” by voice vote, Mayor Inman declared the motion carried.

ORDINANCE APPROVED NO. 21-05

Alderman Vigezzi moved, seconded by Alderman Wynn to adopt the Public Transportation Applicant ordinance, on question being put, Aldermen Wynn, Koch, Carper, Brown-Edwards, Moon, Wayland and Vigezzi being all Aldermen voting “Aye” on roll call and no “Nay” votes, Mayor Inman declared the motion carried and the ordinance was approved and became Ordinance No. 21-05.

City Attorney Scalf presented the following resolution:

Acceptance of the Special Warranty

WHEREAS, Section 5311 of the Federal Transit Act of 1964, as amended, make funds available to help offset certain operating deficits of a system providing public transit service in non-urbanized areas; and

WHEREAS, 49 U.S.C § 5333(b) requires that fair and equitable arrangements must be made to protect the interests of employees affected by such assistance as a condition of receipt of funds under Section 5311; and

WHEREAS, a simplified process for assuring employee protections that accommodates the needs of participants in the Section 5311 program has been agreed upon by the U.S. Department of Labor and the U.S. Department of Transportation by allowing execution of a Special Section 5333(b) Warranty for Section 5311 projects (Special Warranty), which the Secretary of Labor certified on May 31, 1979;

NOW, THEREFORE, BE IT RESOLVED BY THE GOVERNING BOARD OF THE CITY OF MACOMB:

Section 1. That an application be made to the Office of Intermodal Project Implementation, Department of Transportation, State of Illinois, for a financial assistance grant under Section 5311 of the Federal Transit Act of 1964, as amended.

Section 2. As a condition of the receipt of Section 5311 funds, the City of Macomb hereby agrees in writing to the terms and conditions of the Special Warranty (attached) regarding fair and equitable arrangements to protect the interests of employees affected such assistance.

RESOLUTION ADOPTED NO. 2021-10

Alderman Moon moved, seconded by Alderman Wynn to adopt the resolution Acceptance of the Special Warranty, on question being put, Aldermen Koch, Carper, Brown-Edwards, Moon, Wayland, Vigezzi and Wynn being all Aldermen voting “Aye” on roll call and no “Nay” votes, Mayor Inman declared the motion carried and the resolution was adopted and became Resolution No. 2021-10.

SOLICIT BIDS TUCK POINTING AT CEMETERY INCREASE BUDGET AMOUNT

Alderman Moon moved, seconded by Alderman Koch to authorize soliciting bids for tuck pointing repairs at Oakwood Cemetery entrance pillars at Lafayette and Randolph Streets and the Cemetery office building and increasing the budgeted amount to $35,000.00, on question being put, Aldermen Carper, Brown-Edwards, Moon, Wayland, Vigezzi, Wynn and Koch being all Alderman voting “Aye” on roll call and no “Nay” votes, Mayor Inman declared the motion carried.

CARL ERVIN APPOINTED ZONING BOARD OF APPEALS

Alderman Vigezzi moved, seconded by Alderman Carper to concur with the appointment of Carl Ervin to the Macomb Zoning Board of Appeals, on questions being put, Aldermen Brown-Edwards, Moon, Wayland, Vigezzi, Wynn, Koch and Carper being all Aldermen voting “Aye” on roll call and no “Nay” votes, Mayor Inman declared the motion carried.

SALLY EGLER CHAIRMAN ZONING BOARD OF APPEALS

Alderman Moon moved, seconded by Alderman Carper to concur with appointing Sally Egler as Chairman of the Macomb Zoning Board of Appeals, on question being put, Aldermen Moon, Wayland, Vigezzi, Wynn, Koch, Carper and Brown-Edwards being all Aldermen voting “Aye” on roll call and no “Nay” votes, Mayor Inman declared the motion carried.

COUNCIL ADJOURNMENT

There being no further business to come before the Council, Alderman Vigezzi moved, seconded by Alderman Wynn to adjourn, all Aldermen voting “Aye” by voice vote and Mayor Inman declared the motion carried and they adjourned at 5:51 p.m.
