Jacksonville City Council met July 11.

Here are the minutes provided by the council:

SPECIAL NOTICE REGARDING THE COVID-19 PANDEMIC 

Members of the public have the option to attend the in-person City Council meeting or watch the live City Council meeting via live video located on the City of Jacksonville’s website www.jacksonvilleil.gov 

The Jacksonville City Council Meeting was called to order at 6:26 p.m. by Mayor Andy Ezard in the Council Chambers of the Municipal Building. The meeting was publicly announced by posting and by written notice to the local newspaper and radio stations.

ROLL CALL: The following answered present: Aldermen Mike Bartlett, Don Cook, Brett Henry, Kent Hannant, Lori Large Oldenettel, Alison Rubin de Celis, Aaron Scott, Mary Watts; Mayor Andy Ezard; City Attorney Dan Beard; City Clerk Skip Bradshaw. Absent from the meeting were Aldermen Darcella Speed and Eren Williams. A quorum was declared.

MINUTES: Motion was made by Scott, seconded by Henry, to approve the June 27, 2022 Minutes as presented in advance. By voice vote, motion carried. 

PETITIONS: No discussion.

COMMUNICATIONS: No discussion.

CLAIMS: Motion was made by Rubin de Celis, seconded by Watts, to pay claims when funds are available. By voice vote, motion carried. 

MAYOR’S REPORT: No discussion.

CITY ATTORNEY’S REPORT: 

CA Beard reminded the Council that Item #1 under Consent Agenda/Planning & Public Works will be amended to read that the proposal is for 2 mowing tractors, one for the Municipal Services/Street Department and one for the Parks & Lakes Department.

1. Second reading of an ordinance amending the Jacksonville Municipal Code, Chapter 3 Alcoholic Beverages, Article II Retail Sale, Division 2 Licenses, Section 3-64, Location, change of location, limitations on number issued – increase Class D, DD, E, EE and BH licenses by one, total 19. (China King Jacksonville Gao LLC). Motion was made by Cook, seconded by Henry, to accept the second reading of the ordinance. CA Beard read the ordinance as proposed.

2022-O-010 Be it ordained by the City Council of the City of Jacksonville, Morgan County, Illinois, that an Ordinance AMENDING THE JACKSONVILLE MUNICIPAL CODE, CHAPTER 3 ALCOHOLIC BEVERAGES, ARTICLE II RETAIL SALE, DIVISION 2 LICENSES, SECTION 3-64 LOCATION; CHANGE OF LOCATION; LIMITATIONS ON NUMBER ISSUED (Increase Class D, DD, E, EE and BH licenses by one, total 19), is hereby approved. 

Mayor Ezard advised that all mowing fines due to the City of Jacksonville by the owner of China King have been paid. He then asked for discussion and there was none.

ROLL CALL: 6 Yeas; 0 Nays; 2 Abstain (Hannant, Watts); 2 Absent (Speed, Williams) Motion carried 6-0-2-2.

PUBLIC COMMENT: 

Hugh Henderson recently attended a presentation by representatives of the Illinois Chapter of the Sierra Club objecting to the construction of a carbon dioxide (CO2) pipeline in Morgan County, Illinois. This pipeline is designed to capture and transport liquid CO2 resulting from corn ethanol production to the Archer Daniels Midland (ADM) Refinery in Decatur, Illinois. Mr. Henderson expressed his concerns regarding the safety of this project and the close proximity of the pipeline to residential areas. Mayor Ezard thanked Mr. Henderson for his time, and advised that the City of Jacksonville is not involved in this undertaking, and that discussion should be directed to Morgan County.

1. First Reading of an Ordinance amending the Jacksonville Zoning Ordinance No. 1765, Article 2 Definitions and Article 4 District Regulations. Motion was made by Scott, seconded by Rubin de Celis, to accept the first reading of the ordinance. CA Beard read the ordinance as proposed.

2022-O-011 Be it ordained by the City Council of the City of Jacksonville, Morgan County, Illinois, that an Ordinance AMENDING THE JACKSONVILLE ZONING ORDINANCE NO. 1765, ARTICLE 2 DEFINITIONS AND ARTICLE 4 DISTRICT REGULATIONS – (Adding definitions for Bed & Breakfasts and Short-term rentals and allowing those as Special Uses in various zoning classifications), is hereby approved. 

Mayor Ezard asked for discussion and there was none.

2. First Reading of an Ordinance amending the Jacksonville Municipal Code, Chapter 24 Taxation, Article VII Hotel and Motel Tax, Section 24-171 Definitions and Section 24- 172 Imposed; reimbursement; duty of operator to pay. Motion was made by Scott, seconded by Watts, to accept the first reading of the ordinance. CA Beard read the ordinance as proposed.

2022-O-012 Be it ordained by the City Council of the City of Jacksonville, Morgan County, Illinois, that an Ordinance AMENDING THE JACKSONVILLE MUNICIPAL CODE, CHAPTER 24 TAXATION, ARTICLE VII HOTEL AND MOTEL TAX, SECTION 24-171 DEFINITIONS AND SECTION 24- 172 IMPOSED; REIMBURSEMENT; DUTY OF OPERATOR TO PAY – (For Short-term rentals), is hereby approved.

Motion was made by Scott, seconded by Bartlett, to accept the first reading of the ordinance. CA Beard read the ordinance as proposed.

2022-O-013 Be it ordained by the City Council of the City of Jacksonville, Morgan County, Illinois, that an Ordinance AMENDING THE JACKSONVILLE MUNICIPAL CODE, CHAPTER 15 LICENSES, ADDING ARTICLE VII SHORT TERM RENTALS, SECTION 15-141 THROUGH SECTION 15- 148, is hereby approved.

Mayor Ezard asked for discussion and there was none.

OLD BUSINESS: 

Ald. Oldenettel asked for an update on the mowing of the JDC Grounds. Mayor Ezard is hopeful that the State will continue to mow but it is an ongoing process. Several aldermen expressed their dissatisfaction with the situation and are also hopeful that there will be some sort of resolution to the matter in the near future. Ald. Oldenettel thanked Mayor Ezard for his efforts to get this situation under control and stated that the grounds look much better than before.

NEW BUSINESS: 

Ald. Oldenettel advised that the next Neighborhood Improvement Project effort will be held on Saturday, July 23rd at 8:00 a.m. All are invited and encouraged to attend. She noted that 119 bags of litter have been disposed of since the inception of this project in March, 2022.

ADJOURNMENT: With no further discussion, motion was made by Cook, seconded by Henry, to adjourn the meeting at 6:45 p.m.
