McDonough County Board Law & Legal Committee met March 6.

The Law & Legal Committee held its monthly meeting on Monday, March 6, 2023 at 7:00 p.m. The meeting was held at the McDonough County Courthouse, Courtroom 201. Committee Members present included Committee Chair Joe Erlandson, Vice Chair Ken Durkin, Eric Blakeley, Eric Chapman, Letha Clark, Michael Kirby, and Terra Litchfield. Member Travis Hiel was absent. Other persons in attendance were State’s Attorney Matt Kwacala, Patrick Stout, Tim Lobdell, Dave Schaab, Ric Smart, Deborah Cousins, Sheriff Nick Petitgout, County Chair Scott Schwerer, and County Clerk Gretchen DeJaynes.
Chair Erlandson called the meeting to order at 7:00 p.m.
Review & Approve February 6, 2023 Minutes
Member Durkin moved with a second by Member Chapman to approve the minutes as submitted. Motion carried on a voice vote.
Waste Management Update
Dave Schaab gave the report.
Tri-County Recycling
Tim Lobdell gave the report.
Veteran’s Assistance and Van Report
Ric Smart gave the report. 10 Veterans were given assistance in February. Total assistance amounted to $2,387.15.
Sheriff’s Report
Sheriff Nick Petitgout gave the report.
Assessor’s Office Update
Assessor Deborah Cousins gave the report.
Approve Intergovernmental Agreement Between McDonough District Hospital and the McDonough County Sheriff’s Department Regarding Medical Services
Sheriff Petitgout gave a brief overview of the agreement. A change was made for the payment to be due by the last day of the month.
Member Durkin moved with a second by Member Blakeley to approve the Intergovernmental Agreement Between McDonough District Hospital and the McDonough County Sheriff’s Department Regarding Medical Services. Motion carried on a voice vote.
Wind Ordinance Amendments
State’s Attorney Matt Kwacala believes we should wait a month to see if more changes are made. Member Durkin has rewritten our current ordinance.
Carbon Pipeline Development Agreement
Kwacala stated that the previous case had been closed. He said that prior to the agreement being passed the moratorium will need to be removed. Kwacala informed the Committee that he has concerns with the agreement.
Carbon Pipeline-Petition to Intervene
Chair Erlandson informed the Committee that there is not a timeline for intervention at this time.
Member Chapman moved with a second by Member Litchfield to retain attorney Joseph Murphy to intervene. Motion carried on a voice vote.
Claims Review and Approval
Member Kirby moved with a second by Member Clark to approve the claims as submitted. Motion carried on a voice vote.
