McDonough County Board Law & Legal Committee met April 3.

The Law & Legal Committee held its monthly meeting on Monday, April 3, 2023 at 7:00 p.m. The meeting was held at the McDonough County Courthouse, Courtroom 201. Committee Members present included Committee Chair Joe Erlandson, Vice Chair Ken Durkin, Eric Blakeley, Eric Chapman, Letha Clark, Travis Hiel, Michael Kirby, and Terra Litchfield. Other persons in attendance were Patrick Stout, Dave Schaab, Ric Smart, Deborah Cousins, Sheriff Nick Petitgout, Chief Deputy Adam Cremer, Lieutenant Robby Phelps, County Chair Scott Schwerer, and County Clerk Gretchen DeJaynes.
Chair Erlandson called the meeting to order at 7:00 p.m.
Review & Approve March 6, 2023 Minutes
Member Durkin moved with a second by Member Kirby to approve the minutes as submitted. Motion carried on a voice vote.
Waste Management Update
Dave Schaab gave the report.
Tri-County Recycling
Tim Lobdell was absent. Member Litchfield is also on the Tri County Resource and Waste Management and she informed the Law & Legal Committee that they are short two members.
Veteran’s Assistance and Van Report
Ric Smart gave the report. Nine Veterans were given assistance in March. Total assistance amounted to $2,090.15.
Sheriff’s Report
Sheriff Nick Petitgout gave the report.
Assessor’s Office Update
Assessor Deborah Cousins gave the report.
Wind Ordinance Amendments
Member Durkin made a few changes to the Ordinance. Member Chapman moved with a second by Member Hiel to send Draft 3 of the Wind Ordinance to Full Board. Motion carried on a voice vote.
CO2 Pipeline Discussion
Chair Erlandson gave an overview of all of the entities that had filed to intervene.
Claims Review and Approval
Member Hiel moved with a second by Member Clark to approve the claims as submitted. Motion carried on a voice vote.

Executive Session
A motion to enter into Executive Session was made by Member Durkin with a second by Member Litchfield to discuss litigation pursuant to Chapter 5, Illinois compiled statutes Section 120/2 c (1) (2)(11) – Hear FOP Grievance at 7:24 p.m. Motion carried with a roll call vote of 8 yeas, 0 nays, 0 pass, and 0 absent.
A motion to exit Executive Session was made by Member Durkin with a second by Member Clark at 8:07 p.m. No action taken. Motion carried with a roll call vote of 8 yeas, 0 nays, 0 pass, and 0 absent.
Member Chapman moved with a second by Member Blakeley to have County Chair Schwerer contact the Union to see if the Union would wave the 40 hour restriction for part-time Deputies until November 30, 2023. Motion carried on a voice vote.
